Terms of Service

Terms of Service

Effective Date: August 10, 2026

Last Updated: August 10, 2026

These Terms of Service (“Terms”) govern your access to and use of Unfolde Family (the “Service”), including the website and application located at tryunfolde.com (the “Platform”), operated by Unfolde Technologies, LLC, an Arizona limited liability company (“Company,” “we,” “us”).

By checking the box indicating your agreement at signup and creating an account, you agree to be bound by these Terms. If you do not agree, do not create an account or use the Service. These Terms contain a binding arbitration provision and a class action waiver in Section 18, which affect your legal rights.

We record the date and time of your acceptance and the version of these Terms in effect at that time.

1. Description of the Service

Unfolde Family uses artificial intelligence — including third-party image-generation models — to transform user-uploaded photographs into stylized renderings (fantasy, superhero, artistic, and comic-strip formats) while preserving the recognizable facial identity of the person depicted. Unauthenticated visitors may view the public landing page but must register and log in to access transformation features.

2. Eligibility and Age Requirements

2.1 Minimum Age and Teen Accounts. The Service is not directed to children under 13. Every user must confirm their age range at an age-gate at signup before proceeding. An account confirmed as belonging to a user aged 13 to 17 is a "Teen Account" and is subject to the additional limits in Section 5.3. Age confirmation is self-reported and we do not independently verify it, so the protections in Section 5 apply to every account, not only to accounts identified as Teen Accounts.

2.2 Default Safety Settings. Because the age confirmation at signup is self-reported and we do not verify it, the Service remains likely to be accessed by people under 18. Every account — regardless of the age entered at signup — therefore starts with our most protective settings enabled by default: Graphic Mode off, content restrictions on, and age-restricted transformation types blocked. Confirming an age of 18 or older at signup does not unlock age-restricted content, loosen any default setting, or remove the protections described in Section 5.

2.3 Automated Age Estimation. The Service applies AI-based age estimation to uploaded photographs and will block certain transformation types (including swimwear and body-modification styles) where the subject appears to be under 18, regardless of the account holder's stated age. This is a safety measure, not a guarantee — the estimation may be inaccurate, and you remain responsible for ensuring your use of the Service complies with these Terms. The estimated age is used only to make this content-safety determination and is not repurposed for any other use.

2.4 No Circumvention. You agree not to misrepresent your age, or attempt to defeat the age-gate, default safety settings, or age-estimation features.

3. Accounts and User Roles

3.1 Registration. Accounts are created and authenticated through our platform's built-in login system (email and password, or Google sign-in).

3.2 User Roles. There are two account roles:

  • 3.2.1 Standard users — can upload photos, generate transformations, purchase and use credits, and manage their own account and content. Row-level security restricts standard users to their own records.
  • 3.2.2 Administrators — Company personnel with elevated access for support, moderation, and security purposes, including the ability to view or manage user records across accounts, invite new users, and access internal dashboards. There is no separate admin login — the same authentication flow applies, and elevated access is granted based on account role.

3.3 Account Security. You are responsible for safeguarding your login credentials and for all activity under your account.

4. User Content and License Grant

4.1 Your Content. You retain ownership of the photographs and other content you upload ("User Content").

4.2 License to Us. You grant Company a worldwide, non-exclusive, royalty-free license to store, reproduce, and process your User Content in order to operate the Service, generate the transformations and comic strips you request, maintain security and prevent fraud, and enforce usage limits — including sending your photographs to third-party AI processing providers as described in Section 9. This license ends when you delete the applicable content or your account, except as needed to comply with legal obligations or resolve disputes.

4.3 Your Representations. By uploading a photograph, you represent that it depicts you, or that you have the express consent of every identifiable person shown (or their parent/guardian, if a minor) to upload it and have it processed as described in these Terms, and that the upload does not infringe any third party's rights.

5. Biometric Information — Notice and Consent

5.1 What We Collect. To generate transformations, the Service analyzes facial characteristics in your uploaded photographs, including facial feature descriptions and facial landmark coordinates ("Facial Data"). Before this processing occurs, you must affirmatively check a consent box and click "I Consent," and a timestamp of that consent is recorded.

5.2 Consent. By providing this consent, you agree to the collection, use, and processing of your Facial Data as described in these Terms and our Privacy Policy. If your account is a Teen Account, no Facial Data is generated and no AI facial analysis is performed unless a parent or guardian has first given verifiable consent as described in Section 5.3.

5.3 Teen Accounts (Ages 13 to 17). If your account is a Teen Account, we apply the following limits to your account, and you agree not to disable or attempt to circumvent them: we do not generate Facial Data or perform AI facial analysis on your photographs, other than the age estimation described in Section 2.3, unless a parent or guardian has first given consent by completing a transaction using a credit card, debit card, or other online payment method that notifies the primary holder of that payment account of the transaction, using a payment method belonging to the consenting parent or guardian and not to the Teen Account holder; Graphic Mode is unavailable; age-restricted transformation types are blocked; the referral program is unavailable, so a Teen Account neither collects nor submits another person's email address; and we do not send marketing communications. We use that transaction only to confirm that the person consenting is an adult, and we do not receive or store full card details. A parent or guardian may withdraw that consent at any time by contacting us at legal@transformme.net, and we will stop generating Facial Data for the account and delete any Facial Data then held.

5.4 Photographs of Others and of Minors. If you upload a photograph depicting anyone other than yourself, you represent that you have obtained that person's consent — or, if that person is a minor, the consent of their parent or legal guardian — to the collection and processing of that person's Facial Data as described in this Section. Where you upload a photograph of a minor in your care, you provide the consent required by Section 5.2 on that minor's behalf, and you are responsible for the accuracy of that representation.

5.5 Withdrawal. You may withdraw biometric consent and request deletion of your Facial Data at any time by contacting us at legal@transformme.net or through the Account & Data page.

5.6 Retention and Destruction. Facial Data is used solely to generate the transformation you request and is permanently deleted as soon as that transformation completes or fails. We do not retain Facial Data after processing, and neither we nor our AI processing providers use it to train or fine-tune any model, as required by our agreements with those providers. Retention of your uploaded photographs and the resulting transformations is separate and is governed by Section 4.2 and our Privacy Policy. Our written biometric policy — including our retention schedule, our guidelines for permanent destruction of Facial Data, and our protocol for responding to a security incident affecting it — is set out in our Privacy Policy.

5.7 Not Available Everywhere. Because of state-specific biometric privacy laws, the Service is not currently available to residents of Illinois, Texas, or Washington, and access is restricted using IP-based geolocation. If you attempt to access the Service from one of these states, you will be blocked from registering or using transformation features.

6. Prohibited Conduct

6.1 You may not use the Service to create, upload, or generate content that:

  • 6.1.1 depicts an identifiable real person without their consent, including in a sexual, degrading, or non-consensual manner;
  • 6.1.2 sexualizes a minor in any form, real or stylized, or attempts to circumvent the Service's age-estimation safety measures;
  • 6.1.3 impersonates another person or creates deceptive "deepfake" content presented as authentic;
  • 6.1.4 infringes any third party's intellectual property, publicity, or privacy rights;
  • 6.1.5 is unlawful, harassing, hateful, or promotes violence; or
  • 6.1.6 attempts to reverse-engineer or extract training data from the Service's underlying models.

6.2 We may review, remove, and report content violating this Section, and may suspend or terminate accounts responsible for it, including referral to law enforcement where legally required or appropriate.

7. Credits, Free Trials, and Payment

7.1 Free Trial. New users receive 3 free trial credits upon signup.

7.2 Credit Packs. Additional credits may be purchased as one-time, non-recurring packs:

Taster2$1.59
Starter5$2.99
Popular10$4.99
Pro20$7.99

7.3 Credit Usage. A standard transformation costs 1 credit; a comic strip costs 2 credits. Usage is also subject to a daily limit of 20 transformations per account.

7.4 No Expiration. Purchased credits do not expire.

7.5 Payment Processing. Payments are processed by our payment processor (branded as Base44 Payments / Wix Payments). We do not store your full card details — only purchase records and payment status.

7.6 Refunds. All purchases are final and non-refundable, except where required by law or where a transformation fails due to a technical error, in which case the credit used is refunded automatically.

8. Referral Program

If we offer a referral program, participation involves sharing a personal referral code or link, and we will collect the email addresses of people you refer for purposes of crediting your account and administering the program. You may decline to participate in or use the referral program at any time. The referral program is not available to Teen Accounts.

9. Third-Party AI Processing

Uploaded photographs and reference images are sent to third-party AI providers (including Replicate) to generate transformations. These providers process your images under their own data-handling terms, as described further in our Privacy Policy. The Service is operated from the United States and your information is processed there; our Privacy Policy describes the safeguards that apply when information of users in the EEA or the United Kingdom is transferred to the United States. AI-generated results, including character descriptions, names, and stats accompanying transformations, are generated automatically and may not be accurate or consistent between uses.

10. Third-Party Services and Providers

The Service relies on third-party providers to operate — including Replicate (AI image processing), our payment processor (Base44 Payments / Wix Payments), and our hosting, analytics, and email-delivery providers. These providers operate their own systems and are responsible for their own security practices, which Company does not control. Company is not responsible or liable for any act, omission, error, outage, delay, or security incident caused by a third-party provider, except to the extent it results from Company's own failure to exercise reasonable care in selecting or overseeing that provider. Any interaction you have directly with a third-party provider, including any terms they present to you, is governed by that provider's own terms, and Company is not a party to and has no liability under those terms.

11. Output Content and Intellectual Property

11.1 License to You. Subject to your compliance with these Terms and full payment of applicable credits, you may use, reproduce, and share the transformations and comic strips generated from your own User Content for personal, non-commercial purposes.

11.2 No Guarantee of Exclusive Rights. The copyright status of AI-generated output is unsettled in many jurisdictions. We do not represent or warrant that any transformation is eligible for copyright protection.

11.3 Company IP. The Service's software, branding, and underlying technology (excluding your User Content and transformations) are owned by Company or its licensors.

11.4 Feedback. If you send us suggestions, ideas, or other feedback about the Service, you grant Company a perpetual, irrevocable, worldwide, royalty-free license to use and incorporate that feedback without obligation or compensation to you.

12. Disclaimers

AI-generated results may not be accurate, realistic, or appropriate for your intended use. Sample previews are illustrative only and may not match your actual result. The Service is provided "as is" without warranties of any kind, and we do not warrant that age-estimation or content-moderation features will catch every instance of prohibited content.

13. Limitation of Liability

13.1 General Limitation.

To the maximum extent permitted by law, Company will not be liable for indirect, incidental, special, or consequential damages. Company's total liability for any claim arising from these Terms is limited to the greater of the amount you paid in the preceding 12 months or $100.

13.2 Third-Party Acts and Security Incidents.

Without limiting the above, Company is not liable for any damage, loss, or claim arising from: (a) the acts, omissions, errors, or security practices of any third-party provider, including Replicate, our payment processor, or our hosting providers; (b) any security incident, data breach, or unauthorized access to your information, except to the extent directly caused by Company's own gross negligence or willful misconduct; or (c) the acts or content of other users of the Service.

13.3 Force Majeure.

Company is not liable for any delay or failure to perform resulting from causes beyond its reasonable control, including third-party service outages, internet or infrastructure failures, cyberattacks directed at a third-party provider, acts of God, war, terrorism, or governmental action.

13.4 Carve-Out.

Nothing in this Section limits Company's liability for its own fraud, willful misconduct, or gross negligence, or for any liability that cannot be limited or excluded under applicable law.

14. Indemnification

14.1 You agree to indemnify, defend, and hold harmless Company, its officers, directors, employees, contractors, and agents (collectively, the "Company Parties") from and against any and all claims, demands, actions, damages, losses, liabilities, judgments, settlements, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • 14.1.1 your use of the Service;
  • 14.1.2 your User Content, including any claim that it infringes, misappropriates, or violates the intellectual property, publicity, or privacy rights of any third party;
  • 14.1.3 your breach of these Terms, including the representations in Section 4.3;
  • 14.1.4 your violation of Section 6 (Prohibited Conduct);
  • 14.1.5 your violation of any applicable law or regulation; or
  • 14.1.6 your negligent or wrongful conduct — except to the extent any of the foregoing arises from a Company Party's own gross negligence or willful misconduct.

14.2 Company reserves the right, at your expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with Company's defense of that claim. You may not settle any claim subject to this Section without Company's prior written consent. This Section survives termination of your account and these Terms.

15. Copyright Complaints (DMCA)

Send infringement notices compliant with 17 U.S.C. § 512 to our designated agent: Stephen Maya, Unfolde Technologies, LLC, 5008 E Thomas Rd, Apt 425, Phoenix, AZ 85018; legal@transformme.net; (305) 896-5828. Company has registered this agent with the U.S. Copyright Office DMCA Designated Agent Directory (Registration No. DMCA-1076084).

Repeat Infringers. Company has adopted and reasonably implements a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers. We record notices of claimed infringement we receive and the accounts they concern, and an account that accumulates repeated substantiated notices will be terminated.

Counter-Notice. If your content was removed in response to a notice and you believe the removal was the result of mistake or misidentification, you may send a counter-notice meeting the requirements of 17 U.S.C. § 512(g) to the agent identified above. We may restore the content unless the complaining party notifies us that it has filed an action seeking a court order to restrain the allegedly infringing activity.

16. Suspension, Termination, and Administrative Actions

We may suspend or terminate accounts for violations of these Terms, safety concerns, or fraud. Because administrators have the technical ability to view, update, or delete user records, you acknowledge that Company personnel with the administrator role may access your account information for support, security, and moderation purposes as described in our Privacy Policy.

You may stop using the Service and close your account at any time through the Account & Data page or by contacting us at legal@transformme.net.

On termination by either party, your right to use the Service ends immediately; unused credits are forfeited and are not refundable except where required by law or under Section 7.6; and we will delete or de-identify your User Content and Facial Data in accordance with our Privacy Policy, except where retention is required to comply with a legal obligation, resolve a dispute, or enforce these Terms.

Sections 4.2 (solely as to content retained under the exception stated in that Section), 11, 12, 13, 14, 18, 19, and this Section survive termination of your account and these Terms.

17. Geographic Restrictions

The Service is not available to residents of, or to users accessing the Service from, Illinois, Texas, or Washington, and access from these states is blocked using IP-based geolocation.

18. Dispute Resolution; Arbitration

18.1 Informal Resolution. Contact us at legal@transformme.net before filing any claim.

18.2 Arbitration. Except for small-claims matters or claims for injunctive relief regarding intellectual property, any dispute arising out of or relating to these Terms or the Service will be resolved by binding, individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, as modified by this Section. The arbitration will be conducted by a single arbitrator, and judgment on the award may be entered in any court of competent jurisdiction. Unless the parties agree otherwise, any in-person hearing will take place in Maricopa County, Arizona; the arbitrator may otherwise conduct the proceeding by telephone, by videoconference, or on the written submissions. The arbitrator has exclusive authority to resolve any dispute about the interpretation, applicability, or enforceability of this Section, except that a court has exclusive authority to decide the enforceability of the class action waiver below.

18.3 Class Action Waiver. You and Company each agree to bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate the claims of more than one person and may not preside over any form of representative proceeding. If this waiver is found unenforceable as to a particular claim or request for relief, that claim or request must proceed in court and is severed from any claims proceeding in arbitration.

18.4 Jury Trial Waiver. To the extent any claim proceeds in court rather than arbitration, you and Company each knowingly and voluntarily waive any right to a trial by jury.

18.5 Arbitration Fees. Filing, administration, and arbitrator fees will be allocated under the AAA Consumer Arbitration Rules. Company will pay any portion of those fees that the AAA rules assign to it, and will pay your share where the AAA determines you are unable to pay or where payment by Company is necessary for this Section to be enforceable.

18.6 Right to Opt Out. You may opt out of this Section (other than the informal resolution provision above) by sending written notice to legal@transformme.net within 30 days after you first accept these Terms. Your notice must include your name and the email address associated with your account. Opting out will not affect any other part of these Terms and will not affect your use of the Service.

18.7 Survival. This Section survives termination of your account and these Terms.

19. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-laws principles, except where applicable law requires otherwise. For any claim not subject to arbitration under Section 18, you and Company consent to the exclusive jurisdiction and venue of the state and federal courts located in Maricopa County, Arizona, and each waives any objection to that forum on grounds of inconvenience.

20. Changes to These Terms

We may modify these Terms from time to time. If we make a material change, we will update the Last Updated date above and give you reasonable advance notice — at least 30 days before the change takes effect — by email to the address associated with your account, by in-product notice, or both. Changes that are not material, and changes we are required to make to comply with law, may take effect immediately upon posting.

Continued use of the Service after a change takes effect constitutes acceptance of the modified Terms. If you do not agree to a change, you must stop using the Service and may close your account under Section 16 before the change takes effect. We will not apply a material change retroactively to a dispute that arose before that change took effect.

21. General

Entire Agreement. These Terms, together with our Privacy Policy, are the entire agreement between you and Company regarding the Service and supersede any prior or contemporaneous agreements or understandings on that subject.

Severability. If any provision of these Terms is held unenforceable, that provision will be limited or severed to the minimum extent necessary and the remaining provisions will remain in full force and effect.

No Waiver. Company's failure to enforce any provision of these Terms is not a waiver of that provision or of any other right.

Assignment. You may not assign or transfer these Terms or your account without Company's prior written consent. Company may assign these Terms in connection with a merger, acquisition, reorganization, or sale of all or substantially all of its assets. Any attempted assignment in violation of this Section is void.

Notices. We may give you notice by email to the address associated with your account or by in-product notice, and that notice is effective when sent. You must send notices to Company at legal@transformme.net.

Headings. Section headings are for convenience only and do not affect the interpretation of these Terms.
